How UIM Works
The minimum insurance coverage required by law is $25,000 for injuries. Underinsured motorists’ coverage through your insurance company provides coverage when you are injured in an accident that was caused by a driver who does not have car insurance or does not have enough coverage to fully compensate you for your damages. Although not required, having at least $100,000 in UIM coverage is recommended.
Filing a UIM Claim
It is important to notify your insurance company immediately if you were in an accident. Most insurance companies have strict rules about notifying the company to secure compensation through your UIM coverage. If you don’t notify them immediately, you may find that your claim is denied. This coverage is secondary to the at-fault driver’s, so you will need to recover compensation to the limits of the at-fault driver’s company before filing a claim.
In order to recover full compensation, you must:
- Notify your insurance company right away
- Show proof that the other driver doesn’t have insurance
- Recover compensation from the at-fault driver’s policy first
- Get the consent of your UIM insurance company before accepting a settlement offer
Insurance companies often seek to pay the minimum possible on all claims, regardless of whether the company covers the at-fault driver or your own policy. If you fail to follow the procedures, you may lose the right to compensation. In addition, if you don’t have legal representation, you may recover less than you are entitled to under your policy. Our uninsured and underinsured motorist claim attorneys in Olympia can handle the insurance company to maximize your compensation.
